A prominent legal expert, Harry Litman, has warned that a lawyer representing former President Donald Trump in a lawsuit over a 30-year-old rape accusation is likely to take some chances during cross-examination of the alleged victim, E. Jean Carroll. Litman, who is also a former U.S. Attorney and Deputy Assistant Attorney General, explained that with Trump not expected to testify in the trial, attorney Joe Tacopina will be forced to aggressively cross-examine E. Carroll.
Carroll, an esteemed journalist, alleges that Trump raped her in a luxury New York City department store dressing room three decades ago. She claims that the former president lied about it when she publicly accused him of the crime.
Litman acknowledged the risks involved with such an approach during cross-examination: "A scorched-earth approach could backfire," he said. He further explained that aggressive tactics might alienate jurors or create sympathy for Carroll amongst them.
