An appeals court in San Francisco has ruled that Elizabeth Holmes must begin serving her prison sentence while she appeals her conviction on charges of defrauding investors in the failed blood-testing startup. Holmes was convicted at trial last year and sentenced to 11 years and three months in prison. She had asked the 9th U.S. Circuit Court of Appeals to pause her sentence on April 25, two days before she was scheduled to report for imprisonment.
The Ninth Circuit Court of Appeals rejected Holmes' request on Tuesday, ruling that she cannot remain free during the appeal process. The decision will separate Holmes from her partner William "Billy" Evans and their young children.
Ramesh "Sunny" Balwani, former Theranos president and Holmes' ex-lover, was also found guilty of fraud charges last July in a separate trial. Lawyers representing Holmes are challenging the outcome due to allegations of mistakes and misconduct during her trial.
In addition to denying bail, U.S. District Judge Edward Davila ordered both Elizabeth Holmes and Sunny Balwani to pay $452 million in restitution for those harmed by their crimes; they are being held jointly liable for this amount.
Holmes is appealing her conviction based on questions surrounding whether Theranos products functioned correctly as promised, along with false claims made about these products presented as evidence throughout the trial proceedings.
